TERMS AND CONDITIONS — B&B SPITERI AUTOMOTIVE T/A BOSCH CAR SERVICE MILPERRA

  1. INFORMATION AND PRIVACY

B&B Spiteri Automotive collects personal information on repair orders to assist in providing products and services to you. If you do not provide this information, we may be unable to perform requested services.   1. AUSTRALIAN CONSUMER LAW (ACL) REPAIR NOTICE

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair goods in some situations.

Loss of Stored Data: Repair work may result in the loss of user-stored data (including but not limited to integrated multimedia systems, satellite navigation, trip computers, Bluetooth settings, electronic address books, and radio codes). Please ensure you have backed up all data prior to service.

  1. SERVICING & REPAIR AUTHORITY

By authorising work (verbally, via text, email, or signature), you authorise B&B Spiteri Automotive to perform the requested repairs, purchase required parts/materials, and operate the vehicle on public roads or testing tracks for diagnostic, road-testing, or inspection purposes.

  1. ESTIMATES & ADDITIONAL WORK

Estimates are based on anticipated labour and parts. Unexpected complications or concealed faults may cause deviations from the initial estimate. If additional work or parts are required, we will seek your authorisation before proceeding.

  1. LIMITATION OF LIABILITY & POST-REPAIR DISCLAIMER

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms & Conditions excludes, restricts, or modifies any statutory right or remedy you have under the ACL.

To the maximum extent permitted by law:

Post-Repair Faults & Pre-Existing Conditions: B&B Spiteri Automotive is not liable for vehicle failures, mechanical breakdowns, or faults arising post-repair due to pre-existing vehicle defects, wear-and-tear, customer-declined recommended repairs, or failure by the customer to perform routine maintenance (e.g., fluid levels, tire pressure).

Duty to Stop & Report: If a warning light, unusual noise, fluid leak, or performance abnormality occurs post-repair, the customer must cease driving the vehicle immediately where safe and notify us. B&B Spiteri Automotive is not liable for secondary or aggravated damage caused by continuing to operate a faulty vehicle.

Loss or Damage in Workshop: We are not liable for loss or damage to vehicles, accessories, or personal items resulting from fire, theft, break-in, storm, vandalism, or acts beyond our reasonable control while the vehicle is on our premises.

Consequential & Indirect Loss: B&B Spiteri Automotive shall not be liable for any indirect, consequential, or economic losses, including but not limited to loss of income, car rental costs, accommodation, towing charges, or travel delays resulting from repair work or vehicle downtime.

  1. WARRANTIES ON PARTS & WORKMANSHIP

Subject to your ACL consumer rights, repairs and installed parts are covered by our standard warranty or the respective manufacturer’s warranty. Warranty coverage is voided if the vehicle or part has been subjected to misuse, neglect, unauthorised modification, motor racing, or improper maintenance.

  1. STORAGE FEES & UNCOLLECTED VEHICLES

Vehicles must be collected within 48 hours of notice of repair completion. Vehicles left uncollected beyond this period may incur a storage fee of $25.00 per day. If a vehicle remains uncollected for more than 60 days without payment or contact, B&B Spiteri Automotive reserves the right to dispose of or sell the vehicle in accordance with the Uncollected Goods Act 1995 (NSW) to recover outstanding costs.

  1. RETENTION OF TITLE & LIEN

Retention of Title: Ownership of all supplied parts remains with B&B Spiteri Automotive until invoice payment is received in full.

Mechanic’s Lien (Retention of Possession): B&B Spiteri Automotive reserves the right to retain possession of the vehicle until all outstanding amounts for parts, labour, storage, and related fees are paid.

  1. NON-PAYMENT & DEBT RECOVERY

In the event of unpaid or defaulted accounts, B&B Spiteri Automotive reserves the right to take legal action or refer the account to a debt collection agency. The customer agrees to pay all reasonable costs incurred in recovering the debt, including debt collection agency fees, court costs, and legal fees.
